Superannuation

From 1 January 2024, superannuation contributions will become part of the National Employment Standards (NES). This means that most employees covered by the NES now have the legal right to pursue action in court under the Fair Work Act for the recovery of unpaid or insufficiently paid superannuation.

While the Australian Taxation Office will continue to oversee compliance, incorporating these contributions into the NES allows employees to seek enforcement through the Fair Work Act.

Given such changes, employers should review current employment contracts and policies to ensure that such documents contain provision for such updates to superannuation entitlements.
